Protection of personal data

Since its foundation 25 years ago, Visual Communication (former AV MEDIA) has been trying to bring inspiration, benefits and enjoyment. We strive to fulfil this endeavour primarily through mutual trust with our customers, employees and business partners. This partnership also applies to a manner in which we treat your personal data. The information provided is protected with utmost seriousness. We collect only the personal data we actually need to cooperate with you best.

This document on the protection of personal data informs you about which data are needed, for which purpose the data are used and how your personal data may be changed, rectified or erased.


BASIC TERMS

Personal Data (the “PD”)
All information about an identified or identifiable individual that may be, directly or indirectly, identified, particularly with reference to a specific identifier, such as name, identification number, location data, network identifier, or to one or more special features of a physical, physiological, psychic, economic, cultural or social identity of the individual.

Data Subject
The data subject is an individual the data of whom are involved, i.e. a customer, an employee, a contractor’s worker etc.

Controller
The controller is an individual or a legal entity or another entity who or which determines the purposes and means of the processing of personal data. In this particular case, the controller is Visual Communication, a.s., company having its registered office at Pražská 63, 102 00 Prague 10, Company ID 06958125, incorporated in the commercial register of the Metropolitan Court in Prague, Section B, File 23324.

Processor
The processor is an individual or a legal entity or another entity who or which processes personal data on behalf of the controller. The controller may only transfer the PD to the processor based on a contract or a different legal act.

Purpose of the Processing of the PD
The aim (activity) for which it is necessary or useful to process the personal data of the data subject.

Scope of the Processing of the PD
A list of the data subject’s specific PD processed for specific purposes.


OUR PRIVACY POLICY

1. We process and protect the PD so as to protect individuals whose personal data are involved.
2. We process only the PD that are necessary and for the period for which it is required to fulfil the specific purpose.
3. We do not transfer the personal data outside the organization unless it is provided by a contract.


RIGHTS OF THE DATA SUBJECT

In connection with the processing of your PD, you have a right:
1. to receive information on the processing of the PD (information on the purpose of the processing, on the identity of the controller, on his legitimate interests, on the recipients of the PD)
2. of access to the PD (a right to obtain from the controller confirmation about the processing of the PD, a right to obtain a copy of the PD processed)
3. to rectification (rectification of the inaccurate PD)
4. to erasure (a right “to be forgotten”)
5. to restriction of processing
6. to portability of the personal data
7. to object to the processing of the personal data
8. to lodge a complaint with the Office for Personal Data Protection


HOW AND WHY WE COLLECT AND PROCESS THE PERSONAL DATA

Website
We process the PD of website visitors using cookies in order to make improvements to the presentation of our services on the website. Therefore, we use the legal ground of a legitimate interest. To use the PD for remarketing and retargeting purposes, we use the legal ground of the Data Subject’s consent.
We process the PD, namely your e-mail address, with the Data Subject’s consent to provide a relevant feedback on a question, request, comment or a different incentive expressed using an electronic contact form.
On the website of www.veskole.cz we provide services to registered users, where we process other PD exclusively for provision of such services based on the consent granted.

Sending Newsletters
We process the PD to ensure the customers’ knowledge by electronic communication (newsletters). If you are our customer, we use the legal ground of a legitimate interest for sending newsletters for 3 years from the last business transaction. To sign up for a newsletter, we also use the legal ground of the Data Subject’s consent which is granted for 3 years.

AV NEWS Magazine
We process the PD to ensure direct mail distribution of company information magazine AV News. If you are our customer, we use the legal ground of a legitimate interest for sending the magazine for 3 years from the last business transaction. To sign up for AV NEWS, we also use the legal ground of the Data Subject’s consent which is granted for 3 years.

Feedback
In order to continuously improve the quality of our services, it is important to us to get feedback and opinion from our customers. To carry out telephone surveys of our customers, we use their PD on the grounds of a legitimate interest resulting from the existing business relationship.

Participation in Events and Trainings
If you register for our trainings or other events organized by us, we process the PD during and subsequently after the event to ensure the needs and meet the expectations of the participants. Usual activities of the processing of the PD include creating an attendance list, identification of a participant (badge), placing a participant to a program, provision of refreshments (as desired), communication during the event, getting feedback, follow-up and other activities. We process the PD when you accept the Terms and Conditions.

Marketing Materials
We often process the PD when preparing and subsequently publishing marketing contents in order to publish case studies, customer references or other marketing materials. Usual forms of the processing of the PD within marketing contents include reference images, audio and video recordings, website articles, posts on social networks and printed materials of the company. In these particular cases, we use the personal data only with the Data Subject’s consent and further with the consent of a legal representative as far as minors are concerned.

Common Business Communication
We process the PD for the purposes of common business communication with future or existing customers, contractors and business partners. It means particularly preparation of quotations, entering into business transactions, dealing with complaints and warranty repairs and upgrade of implemented solutions. In order to process the PD in these situations, we use legal grounds of negotiating execution and performance of a contract and a legitimate interest for 3 years from the last business transaction.
Other PD are applied with a statutory duty to store documents concerning completed business transactions, or business contracts, for subsequent 10 years.

Resolution of Service Events
We collect the PD upon personal, e-mail or phone communication or by entering the PD into a respective on-line form, upon occurrence of a service event. We process the PD to ensure communication when dealing with HW or SW defects and their potential invoicing. Therefore, we use the legal ground of Performance of a contract or negotiating its execution (the Information).

HOW WE PROTECT YOUR PERSONAL DATA

To ensure safety and confidentiality of your PD, which is extremely important to us, we take technical and organizational measures particularly of protection against unauthorized access to the personal data and their abuse, ensuring security of our IT systems and data recovery in case of an incident. We regularly evaluate and update all the measures.
